By the execution of this agreement, I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type, which may occur to me or my guest, and I hereby fully and forever release and discharge the company, its insurers, employees, officers, directors, and associates, from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out the use of said equipment and facilities.

I expressly agree to indemnify and hold the company harmless against any and all claims, demands, damages, rights of action, or causes of action, of any person or entity, that may arise from injuries or damages sustained by me (person holding a subscription).

I agree to be solely responsible for safety and wellbeing of myself. I understand and acknowledge that the use of exercise equipment involves risk of serious injury, including permanent disability and death.

I acknowledge that I am participating in workout classes offered by StayAhead Fitness LLC where I will receive information and instruction about exercising types, physical exercise, and health. I am fully aware that the class/routine requires physical exertion which may cause physical injury, I am fully aware of the risks and hazards involved.

If you are pregnant, please consult your doctor when attempting to follow all of our exercise classes. It is also wise to wait 6 weeks and to get clearance by your health practitioner before resuming exercise after birth . StayAhead Fitness LLC routines are not specifically tailored for pre or post natal exercises or specific conditions unless specified. 

StayAhead Fitness LLC exercises are very safe but, as with all forms of physical exercise, it is prudent to consult your doctor before starting sessions. It is recommended that you consult with a physician before starting a new exercise program and follow their safety recommendations.

These classes, routines, and suggestions are not a substitute for medical counseling or treatment. If you have any doubts about the suitability of the exercises, you should refer back to your medical practitioner.

The teacher, Drew Overholser, can accept no liability for personal injury or damages related to participation in a session online via zoom, in person or prerecorded on the www.stayaheadfitness.com website or www.members.stayaheadfitness.com or the StayAhead Fitness LLC Youtube Channel. Exercise should be performed at a pace which feels comfortable for you.

With this knowledge, I confirm that I am making a voluntary choice to participate and engage in the class/routine and accept all and any risk associated with my decision to participate. I represent and warrant that I am physically fit and have no medical condition that would prevent my full participation in these exercise classes. By taking class with Drew Overholser of StayAhead Fitness LLC virtually, in person or via the content online, you understand and agree that Drew Overholser or StayAhead Fitness LLC has no liability to you for any injury or loss you may suffer in connection with any of our exercise sessions.

The use of any information provided by StayAhead Fitness is solely at your own risk. I confirm agreement for my teacher to contact me with information on classes and other activities and relevant information through email and the StayAhead Fitness LLC newsletter and understand that I have the right to withdraw this ‘consent to be contacted’ at any time. I confirm that I have read and understood the above advice and that the information. I voluntarily agree to the above liability waiver and terms and conditions under my own free will.
